# Community Guidelines Last Updated: May 26, 2026 These Guidelines provide an easy-to-understand summary of the rules for using TokiMake safely and enjoyably. Please read them together with the Terms of Service. In the event that the content of the Terms of Service and these Guidelines differs, the Terms of Service shall in principle prevail (however, with respect to matters specified in detail in these Guidelines, such as the Rating criteria and specific examples of prohibited content, these Guidelines apply). *** ### 1. Purpose of the Guidelines and the User's Responsibility TokiMake is a service that provides a venue for free creation through AI. The Company respects the freedom of creation, but Users must comply with these Guidelines so as not to infringe the rights of other users and third parties. **All responsibility for Posted Content lies with the poster.** Before posting, please confirm for yourself not only whether there is any violation of the Terms of Service or these Guidelines, but also whether there is any problem under generally accepted social norms. Where you receive a claim of rights infringement or the like from a third party, the poster themselves shall responsibly respond. The Company shall in principle not be involved. *** ### 2. About the Rating Assigned to Works Every post is given one of the following Ratings. | Rating | Content | | ------------ | ------------------------------------------------------------------------------------------------ | | **All Ages** | Works that do not contain sexual expression | | **R-18** | Works that contain sexual acts or depictions evocative thereof (limited to persons 18 and older) | Note that excessive violent or cruel expression (lacerations, internal organs, torture, etc.; expression generally called "R-18G") is treated as **prohibited content** regardless of Rating (see Section 3, "Violent and Cruel Expression"). #### Examples of Works Falling Under R-18 (Reference) * Postures of sexual intercourse, conduct similar to sexual intercourse, masturbation, and the like * Nudity, or clothing markedly close to nudity * Depictions that expose or emphasize the genitals, buttocks, nipples, etc. * Expression comparable to the above #### Examples of Works Not Falling Under R-18 (Reference) * Kissing, embracing * Light body contact not amounting to injury * Acts that can be judged, under generally accepted social norms, as acceptable to perform in a public place Note that the final determination of the Rating is made by the Company. #### Requirements for Posting R-18 1. The poster is 18 years of age or older; 2. The adult content feature has been enabled (Article 13 of the Terms of Service); 3. The R-18 flag must be set at the time of posting; 4. The poster themselves confirms that there is no violation of applicable laws and regulations such as Article 175 of the Penal Code (the crime of distributing obscene materials); 5. Titles and descriptions must not contain expressions that attract the interest of persons under 18. #### Regarding Misdeclaration of Ratings If you post with an under-declared Rating, the relevant work will be removed, and repeated instances will be subject to measures such as account suspension. The final determination of the Rating is made by the Company. *** ### 3. Criteria and Specific Examples for Determining Prohibited Content The **legal basis for prohibited content is set forth in Article 12 of the Terms of Service**. This Section sets out the **criteria for determination and specific examples** in each category. Even where not expressly stated in this Section, content that is inappropriate in light of generally accepted social norms may become subject to prohibition. #### Sexual Expression Relating to Children (Strictly Prohibited — Article 12, Items 10–12 of the Terms of Service) **Criteria for Determination** These Guidelines exclude purely anime/illustration-style fictional characters (regardless of age setting) from the scope of prohibition; however, under the U.S. PROTECT Act (18 U.S.C. § 1466A) and other foreign laws and regulations, content depicting non-existent children may also be subject to regulation. When using the Service from overseas, the User bears responsibility for confirming the laws and regulations of their own location (see §8). * Applies **regardless of real existence and the poster's subjective intent, etc.** * "Appearance," "clothing," "height," "setting," and "situation" are judged comprehensively * Even where the age setting is 18 or older, if the appearance looks like that of an infant or child, it is subject to prohibition * Anthropomorphized expression of animals, inanimate objects, etc., is also included in the scope * "Live-action," "so-called AI photos," and other content that could be mistaken for live-action are subject to this **Specific Examples (Subject to Prohibition)** * Combinations of sexual elements with elements indicating school age, such as a randoseru (school backpack), a school uniform, etc. * Sexual depiction of a child-like person expressed in a photorealistic art style * Sexual depiction of an anthropomorphized pet or animal character that nevertheless has a child-like appearance **Response** If these are discovered, they are immediately removed, and a report is made to the National Police Agency, the [Internet Hotline Center](https://www.internethotline.jp/), the U.S. NCMEC, and the like. The poster's account is immediately and permanently banned. #### Non-Consensual Sexual or Defamatory Expression of Real Persons (Article 12, Items 13–14 of the Terms of Service) **Specific Examples (Subject to Prohibition)** * Non-consensual sexual images based on a photograph or likeness, whether of an entertainer, celebrity, or ordinary person (including deepfakes) * Images that defame or insult a real person * Images that invade the private life of a real person (compositing with their residence, workplace, family, etc.) * Sexual or defamatory depiction of a public figure (politician, celebrity) These may violate the **Revenge Porn Prevention Act** and the **Act on Punishment of Acts Related to Photographing of Sexual Body Parts**. #### Violent and Cruel Expression (Equivalent to "R-18G" — Article 12, Item 21 of the Terms of Service) Posting is prohibited regardless of Rating. **Specific Examples** * Detailed depictions of excessive violence, torture, or bloodshed * Detailed depictions of lacerations of the human body or animals, or of internal organs * Content that affirmatively depicts murder, suicide, or self-harm * Animal abuse * Depictions of corpses or dead bodies (excluding medical or historical contexts) * Content that affirmatively depicts sexual assault #### Additional Prohibitions on Sexual Expression (Article 12, Items 19–20 of the Terms of Service) Based on the Terms of Service, sexual expression falling under the following is prohibited. * Sexual acts with animals (bestiality) * Incest based on a real family relationship * Sexual acts with corpses (necrophilia) * Sexual expression involving excrement or filth * Content that affirmatively depicts non-consensual sexual acts (rape, sexual assault) * Sexual depiction of a person in a state of incapacity due to hypnosis, deception, drugs, etc. * Sexual depiction accompanied by criminal acts such as illegal drugs, assault and bodily injury, or aiding suicide * Depictions that carry a risk of imitation or of being mistaken for a real victim * Publication or distribution of content that may violate Article 175 of the Penal Code #### Prohibitions Relating to AI Generation and Misrepresentation of Origin (Article 12, Items 15–18 of the Terms of Service) **Specific Examples** * Posts that cause AI-generated content to be mistaken for "live-action" or "a real person" * Posts that falsely represent non-AI-generated content as "AI-generated" * Posts that falsely represent that AI-generated content has not been processed, when it has been * False statements about the AI model, prompt, or negative prompt used * Acts of circumventing, disabling, or modifying the Company's technical measures, such as automated filters, the content moderation system, image metadata, watermarks, and content provenance displays (**Article 12, Item 9 of the Terms of Service**) #### Unauthorized Use of Musical Works and Lyrics Managed by a Copyright Management Organization (Article 12 of the Terms of Service) It is prohibited to input, reproduce, transmit, or publish the lyrics of a musical work managed by JASRAC, NexTone, or another copyright management organization, without the rights holder's permission, in a prompt, text input, Posted Content, or any other input field on the Service. This prohibition applies to both all and part of the lyrics. *Specific Examples (Subject to Prohibition)* * Inputting song lyrics into a prompt to generate an image * Placing lyrics in the dialogue, captions, descriptions, etc., of a vertical-scroll manga * Writing lyrics in a comment field, profile field, or other text input field * Posting an image containing lyrics (a lyrics card, an illustration with lyrics, etc.) *Regarding Automatic Blocking* The Company has introduced a technical measure that automatically blocks input matching a musical work or lyrics managed by a copyright management organization. This measure does not guarantee the complete prevention of all infringing acts. Even where input is restricted by automatic blocking, if you believe that the use of the song lyrics falls under Article 32 (Quotation) of the Copyright Act, please make a request through the procedure in Section 7 (Appeals). *Response* Where the unauthorized use of song lyrics is confirmed, the relevant content is removed or made private. In the case of repeated violations, feature restrictions or account suspension will apply. Note that, where there is a claim of rights infringement from a copyright management organization, the Company responds in accordance with Article 10 (Copyright Infringement Claims) of the Terms of Service. #### Other Prohibitions (See Article 12 of the Terms of Service) The following prohibited acts set forth in Article 12 of the Terms of Service are also subject to these Guidelines (principal items are excerpted). For an exhaustive list of prohibited acts, please refer to Article 12 of the Terms of Service. * Infringement of the copyright, trademark rights, portrait rights, publicity rights, right to reputation, or privacy rights of a third party (Item 25) * Affirmation of the use or sale of illegal drugs, the manufacture of firearms or weapons, or terrorism or organized crime (Item 24) * Promotion of discrimination or hate speech (Item 22) * Content for the purpose of fraud or phishing (Item 4) * Spamming (Item 31) * Mass generation for the purpose of using the Company's AI output as training data for a competing AI model (Item 32) * Acts that violate laws and regulations or public order and morals (Item 28) *** ### 4. About the Playground Feature #### Public/Private Settings * By default, generated outputs are "private" (viewable only in the poster's own library) * When set to "public," they become viewable by other users * When publishing R-18 content, be sure to set the corresponding flag * Publishing prompts is optional, but published prompts are also subject to review #### Notes Regarding Prompts * Do not include in a published prompt any wording that infringes the personal information or reputation of a third party * Where the prompt itself falls under a prohibited act (such as containing sexual expression relating to children), it is subject to measures regardless of the content of the generated image #### Conditions of Use of the Adult (R-18) Feature 1. You have consented, at account registration or on the settings screen, that you are 18 years of age or older; 2. You have enabled the "I consent to the viewing and generation of adult content" switch; 3. You enable "Display sensitive content" at each generation (a two-step consent). These settings can be disabled at any time. After disabling, the adult feature can no longer be used. *** ### 5. About Reporting Violating Content If you discover content that violates the Guidelines, please contact . When reporting, please clearly state the target URL, the reason you judge it to be a violation, and the reporter's contact information (required in the case of a legal claim). The Company responds according to the nature and urgency of the reported content. It does not guarantee the timing of its response. *** ### 6. About the Handling of Violating Content (Operational Information) The legal basis for moderation is set forth in **Article 14 of the Terms of Service**. This Section sets out the actual mechanism and operational criteria, in order to ensure operational transparency. #### Moderation Mechanism (Operations) * Automated systems check prompts and generated outputs * For reported content and content that is difficult for automated systems to determine, the Company's moderation team conducts human review * Automated systems do not guarantee 100% accuracy, and false positives and oversights may occur * Determinations of measures are made on the basis of the **objective content** of the content, not the poster's subjective intent or awareness #### Operational Criteria for Staged Measures Among the measures set forth in Article 14, Paragraph 2 of the Terms of Service, for minor violations the following stages are used as a guide. | Stage | Measure | Anticipated Situation | | ----- | --------------------------------------------------------------------------------- | -------------------------------------------------------------------------------- | | 1 | Warning | Minor violation, first violation | | 2 | Removal or making private of the relevant content | Existence of violating content | | 3 | Feature restriction (suspension of posting, suspension of the R-18 feature, etc.) | Repeated violations | | 4 | Temporary account suspension (7 to 90 days) | Serious violation, cumulative violations | | 5 | Permanent ban | Serious violation, repeated violations, content equivalent to a criminal offense | Note that, with respect to child sexual abuse, deepfakes of real persons, and content equivalent to a criminal penalty, based on Article 14, Paragraph 4 (Immediate Measures) of the Terms of Service, a permanent ban is imposed immediately without going through the above stages, and a report is made to the police and the like. #### Regarding No Prior Notice / Non-Disclosure of Reasons Based on Article 14, Paragraphs 3 and 5 of the Terms of Service, measures are implemented without prior notice, and the reasons for a measure are in principle not disclosed. This is an operational judgment to prevent abuse. This Section does not impede the User's exercise of rights held under laws and regulations (litigation, etc.). Regarding removal requests for non-consensual intimate images (NCII) Where the Company receives a request for the removal of a sexual image published non-consensually, from the subject in person or their agent, the Company will make reasonable efforts to remove or make private the relevant content within 48 hours of receipt of the request. Please send a removal request to , together with the URL of the target content and a declaration that it is non-consensual. *** ### 7. About Appeals Against Measures A User may file an appeal regarding a measure against their own content (removal, Rating determination, account suspension, etc.). * **Method of submission**: The appeal form on the Site, or * **Items to state**: The ID of the target content, the content of the measure, and the reason for the appeal * **Number of appeals**: **Up to three times in total** per work (including appeals after reposting) * **Appeal deadline**: Within 30 days of the notice of the measure The Company's moderation team conducts a re-review and notifies the result. The final authority to determine the Rating, the permissibility of content, and measures against an account belongs to the Company. *** ### 8. About Use from Overseas * The Service is designed for use within Japan * When using the Service from outside Japan, the User bears responsibility for confirming for themselves that there is no violation of the laws and regulations of their own country of location and the viewer's country of location * The Company does not implement technical access restrictions (geoblocking, etc.) according to the User's location * Where the use of R-18 content or other use of the Service is unlawful in the User's country of location, the User themselves shall bear any and all risks (including criminal liability) associated with use from such country *** ### 9. About Revisions to the Guidelines These Guidelines are revised from time to time in connection with amendments to laws and regulations, changes to the content of the Service, and reviews of moderation operations. * **Material revisions**: Notice is given by posting on the Site and notification to the registered email address, at least 7 days before the effective date * **Minor revisions**: Notice is given by posting on the Site By continuing to use the Service on or after the effective date of the revised Guidelines, the User is deemed to have agreed to the revised Guidelines. *** ### 10.
